GENERAL TERMS AND CONDITIONS OF SALE
Between:
Focus Technology,
with its registered office at Ch. des Clochetons 14, 1004 Lausanne, Switzerland,
represented by Amin Debabeche as President,
hereinafter referred to as the “Seller” or the “Company”.
And:
Any individual or legal entity placing an order through the website www.focus-technology.ch,
hereinafter referred to as the “Customer” or “Buyer”.
PREAMBLE
The Company sells products (jewelry, watches, optical devices) to consumers via its website www.focus-technology.ch. These General Terms and Conditions of Sale (GTCS) apply to all sales made through this website.
Article 1: Purpose
These General Terms and Conditions define the rights and obligations of the parties in connection with the sale of products or services via the website www.focus-technology.ch.
Article 2: General provisions
These GTCS apply to all orders placed through the website. Any order implies full and unconditional acceptance of the GTCS in force on the date of the order. The Customer acknowledges having read these GTCS before confirming their order.
The Seller reserves the right to modify these GTCS at any time. The applicable GTCS are those in effect at the time the order is placed.
The Customer declares that they have the legal capacity to contract under Swiss law or are duly authorized to bind the legal entity they represent.
Article 3: Prices
Prices are indicated in Swiss francs (CHF), inclusive of all taxes (including VAT). Additional shipping fees may apply. For orders delivered outside Switzerland, any applicable customs duties or local taxes are the responsibility of the Customer.
The Seller may change prices at any time. However, the price applicable to the order is the one in effect at the time of purchase.
Article 4: Conclusion of contract
The contract is concluded upon electronic confirmation of the order by the Seller. The Customer proceeds through the following steps:
Selection of product and options;
Entry of personal details;
Order validation with acceptance of the GTCS;
Payment;
Confirmation email from the Seller.
Orders are archived on a reliable and durable medium. Electronic communications are deemed valid proof.
Article 5: Products and services
The essential characteristics of products are described on the website. The Seller ensures the accuracy of prices at the time of the order. Photos are for illustrative purposes only and do not have contractual value.
In case of unavailability, the Customer will be informed. If no alternative is agreed upon, the Customer will receive a full refund.
Article 6: Compliance and warranty
In accordance with the Swiss Code of Obligations, the Seller warrants that products are free from defects at the time of delivery. If a defect is discovered, the Customer may request repair, replacement, or refund within a reasonable time from discovery.
Article 7: Retention of title
The products remain the property of the Seller until full payment of the order is received.
Article 8: Delivery
Deliveries are made to the address provided at the time of the order. Delivery times are estimates only. In case of delay, the Customer may set a reasonable additional deadline before canceling the contract.
The risk of loss or damage passes to the Customer once the products are handed over to the carrier.
Article 9: Availability
In the event of extended unavailability (more than 30 business days), the Customer may cancel the order and request a refund.
Article 10: Payment
Payment is due at the time the order is placed. Payments can be made by credit card (Visa, Mastercard) or bank transfer. If payment is not received, the order will be canceled automatically.
The Seller reserves the right to refuse an order in case of prior disputes or suspected fraud.
Article 11: Right of withdrawal
In accordance with the Swiss Federal Law on Consumer Protection, private Customers have the right to withdraw from the contract within 14 days of receiving the product. The right of withdrawal does not apply to customized or perishable items.
Products must be returned in their original condition. Return shipping costs are borne by the Customer. Refunds will be issued within 14 days of receipt of returned goods.
